JH ONNCALL Private Limited is a healthcare service organization providing professional home healthcare and allied medical support services through qualified professionals and authorized service partners. The Company currently operates from Airoli, Navi Mumbai, Maharashtra, and may expand its services to other locations in India.

1. Scope of Services

The Company may provide or facilitate services including, but not limited to:

  • Home Nursing Care
  • Caregiver / Attendant Services
  • Elder Care
  • Post-Hospitalisation Care
  • Physiotherapy at Home
  • Doctor Visit Coordination
  • Medical Equipment Assistance
  • Diagnostic Sample Collection Coordination
  • Home Healthcare Support
  • Other healthcare support services introduced from time to time.

Availability of services may vary depending upon location, manpower, medical requirements, and operational feasibility.

2. Eligibility

  • Any person aged 12 years or above may use the Platform.
  • Where the patient is a minor or unable to provide consent, the booking must be made
    by a parent, legal guardian or authorised representative. 

3. Acceptance of Booking

Submitting a booking request does not automatically confirm a service.

The Company reserves the right to accept, decline, reschedule, or cancel any booking based on:

  • Service availability.
  • Availability of healthcare professionals.
  • Patient safety considerations.
  • Incorrect or incomplete information.
  • Operational or legal reasons.

4. User Responsibilities

The User agrees to:

  • Provide complete and accurate personal and medical information.
  • Inform the Company of any infectious disease, allergies, or medical risks relevant to service delivery.
  • Ensure that the patient is available at the scheduled time.
  • Provide a safe, hygienic, and respectful environment for healthcare personnel.
  • Cooperate with healthcare professionals during service delivery.

The User shall be solely responsible for any loss, delay, or complication arising from incorrect or incomplete information provided to the Company.

5. Nature of Services

  • The Company provides healthcare support services through qualified professionals or authorized service partners.
  • Unless specifically stated, the Company does not guarantee any particular medical outcome, recovery, diagnosis, or cure.
  • Medical decisions shall always remain the responsibility of the treating doctor and the patient.

6. Pricing and Payments

  • Service charges shall be communicated before confirmation of the booking.
  • Applicable taxes shall be charged as per law.
  • The Company reserves the right to revise its pricing without prior notice. Revised pricing shall not affect bookings already confirmed.

7. Cancellation and Rescheduling

  • Cancellation and rescheduling shall be governed by the Company’s Cancellation & Refund Policy available on the website.
  • Repeated cancellations, misuse of the booking system, or fraudulent bookings may result in suspension of the User’s account.

8. Service Availability

The Company shall make reasonable efforts to provide services at the scheduled time. However, delays may occur due to:

  • Traffic conditions.
  • Weather conditions.
  • Medical emergencies.
  • Staff availability.
  • Government restrictions.
  • Circumstances beyond reasonable control.

Such delays shall not constitute a breach of these Terms.

9. Patient Safety

The User shall immediately inform the Company if:

  • The patient’s condition deteriorates.
  • Emergency medical assistance is required.
  • There is any safety concern at the service location.

For life-threatening emergencies, Users must immediately contact the local emergency medical services or visit the nearest hospital. The Company’s online platform is not a substitute for emergency medical response.

10. User Conduct

Users shall not:

  • Misbehave with Company personnel.
  • Use abusive, threatening, discriminatory, or offensive language.
  • Demand services outside the agreed scope.
  • Offer direct employment or engage Company personnel privately without written approval from the Company.
  • Use the Platform for any unlawful purpose.

The Company reserves the right to discontinue services in such cases without liability.

11. Company's Right to Refuse Service

The Company may refuse or discontinue services if:

  • Incorrect information is provided.
  • Payment obligations are not fulfilled.
  • The service location is unsafe.
  • The User engages in abusive or unlawful conduct.
  • Continued service may endanger the patient or Company personnel.

12. Limitation of Liability

To the maximum extent permitted by applicable law, JH ONNCALL Private Limited shall not be liable for:

  • Indirect or consequential losses.
  • Loss of income or business.
  • Delay caused by circumstances beyond its control.
  • Medical complications resulting from incorrect information provided by the User.
  • Decisions made independently by doctors or patients.

The Company’s total liability, if any, shall not exceed the amount paid by the User for the specific service giving rise to the claim.

13. Indemnity

The User agrees to indemnify and hold harmless JH ONNCALL Private Limited, its Directors, Employees, Consultants, Healthcare Professionals, and Authorized Service Partners against any claims, losses, damages, liabilities, costs, or legal expenses arising from:

  • Breach of these Terms.
  • False or misleading information provided by the User.
  • Misuse of the Company’s services.
  • Unauthorized acts or omissions by the User or the patient’s representatives.

14. Intellectual Property

  • All content available on the website, including text, graphics, logos, designs, software, trademarks, and branding, is the exclusive property of JH ONNCALL Private Limited.
  • No material may be copied, reproduced, modified, published, or distributed without prior written permission from the Company.

15. Privacy

The collection, storage, processing, and use of personal information shall be governed by the Company’s Privacy Policy and applicable Indian laws.

16. Force Majeure

The Company shall not be liable for failure or delay in providing services due to events beyond its reasonable control, including natural disasters, epidemics, strikes, governmental actions, internet failures, power outages, transportation disruptions, or similar events.

17. Governing Law and Jurisdiction

  • These Terms shall be governed by the laws of India.
  • Subject to applicable law, courts at Thane, Maharashtra, shall have exclusive jurisdiction over disputes arising from these Terms.

18. Dispute Resolution

  • The Parties shall first attempt to resolve disputes amicably through mutual discussions.
  • If unresolved, the dispute may be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Airoli, Navi Mumbai, Maharashtra, and proceedings shall be conducted in Marathi and English.

19. Amendments

The Company reserves the right to modify these Terms at any time. Updated Terms shall become effective upon publication on the Company’s website. Continued use of the Platform constitutes acceptance of the revised Terms.
